James H. Landgraf, Esq.

James H. Landgraf is a shareholder in Cureton Clark where he heads the Construction Industry Practice. He provides over twenty years of specialized experience in handling construction contracting and litigation for the benefit of the Firm’s construction industry clients including public and private owners, prime contractors, sub-contractors, suppliers and design professionals. He is further certified by the New Jersey Supreme Court as a Civil Trial Attorney, handling complex commercial and construction litigation for the Firm’s clients.

Jim has practiced as a civil litigation and trial attorney in New Jersey since 1976, handling all manner of civil disputes. Since the early 1980’s his practice has evolved to concentrate on construction industry and complex commercial issues and disputes faced by his clients. He joined the Firm in 1995 as a shareholder and since that time has worked extensively with the Firm’s business and construction clients in developing successful contractual and business relationships and in assisting in resolving disputes arising out of their business and projects.

In his construction industry practice, Jim has been able to utilize a broad perspective for the benefit of Cureton Clark’s clients. His experience in both transactional contract development and litigation provides clients with a greater overview of both issues that can arise and methods of avoiding or resolving those issues. His further experience in representing industry clients over a broad range of interests including public school boards and municipalities, private commercial and residential owners, commercial and residential developers, contractors, sub-contractors, suppliers and design professionals allows him to offer clients a wide range of services that can take into account and recognize all sides of existing and anticipated issues.

Jim maintains a strong level of involvement in Bar Association, trade and civic organizations. These activities have enabled him to access legal and trade developments necessary to stay at the forefront of the industry for the benefit of the Firm’s clients. They have also allowed him to give back the benefits of his experience and expertise to the community and profession through volunteering his time and skills to these organizations.

The legal issue is whether linehaul and pickup and delivery drivers are independent contractors or employees.
